All products sold on our Sites are non-medicinal, nontherapeutic, and contain CBD derived from industrial hemp with a delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3 percent on a dry weight basis, as per federal regulations. All CBD products sold on our sites are derived from 100% Federally legal industrial hemp and conform fully to the U.S Farm Bill 2014, section 7606, as well as U.S. Farm Bill 2018, which federally legalized the cultivation of industrial hemp under certain federally mandated conditions. We do not sell any products that are in violation of the United States Controlled Substances Act (US CSA). While Melanin Hemp Goddess tests and evaluates all of its hemp suppliers to the best of our ability, we cannot be responsible for ensuring that all vendors completely comply with all federal and/or state laws. 

Even though our products contain less than 0.3% THC by dry weight basis, studies have shown that ingesting Full Spectrum CBD can cause confirmed positive results when screening urine and blood specimens. Accordingly, if you are subject to any form of employment drug testing or screening, we recommend (as does the United States Armed Services) that you DO NOT take our products. Before taking our products, consult with your healthcare practitioner, drug screening testing company, or employer. 

You assume all risks when using our products. Our products should be used only as directed on the label. Products should not be used if you are pregnant or nursing or under the age of eighteen (18) years. You should consult with a physician before use of any products if you have a serious medical condition or use prescription medications.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

 

Denial of Access 

 

These Terms & Conditions constitute an agreement that is effective unless and until terminated by Melanin Hemp Goddess. If, in our sole discretion, a customer fails to comply with any provision of this agreement or the Privacy Policy, we may deny such access to the sites. In the event of denial of access by Melanin Hemp Goddess, the customer is no longer authorized to access the sites, and the restrictions imposed upon the customer with respect to intellectual property, and the disclaimers and limitations of liabilities set forth in these Terms & Conditions  shall continue in force. 

 

Order Confirmation and Cancellation

 

By placing an order on our sites, the customer accepts all provisions of the Terms & Conditions and Privacy Policy. An email confirmation summarizing the order details and shipment information will be sent to the customer. For this purpose, customers accept the use of email for receiving notices concerning their order. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Melanin Hemp Goddess reserves the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right to refuse or cancel any order placed by a customer if there is an existing dispute concerning the payment of a previous order of an objective suspicion of fraud. Despite the best efforts to satisfy customer expectations, we may cancel an order even after having send a confirmation by email. In such case, the order will be reimbursed.

 

 Product Description 

We attempt to be as accurate as possible with the descriptions of our products made available for purchase on our Sites. We reserve the right to remove at any time any product displayed on its sites and/or to replace or modify any content or information related to any product and we will not incur any obligation as a result of such change. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

 

Merchandise Availability

The products offered for sale are those described and available on the sites within the limit of available product stock. Information is updated in real time and merchandise availability on our sites is not guaranteed as it may be low in stock. If merchandise is not available by the time your order processes, we will notify you of this via email and your order will be cancelled. Melanin Hemp Goddess is not liable in case of an order cancellation because of stock depletion.

 

Shipping

 

All orders are processed Monday through Friday from 9am-3pm, excluding holidays. Any orders placed after 3 pm will not be processed until the next business day. Any order made on Saturday or Sunday will not be processed until Monday morning, excluding holidays. Please allow 2-3 business days for your orders to be processed. Once shipped, customer will receive a tracking number that will be sent separately via email. We ship our products through USPS in the USA ONLY. WE DO NOT SHIP INTERNATIONALLY. Shipping is a flat rate of $12 and may take up to 7 BUSINESS DAYS. Once we have delivered the order USPS, USPS Shall be responsible to ensuring the delivery of the order. The delivery shall be made to the delivery address indicated by the customer at the time of placement of the order. Customer must make sure that they have provided accurate and complete information concerning the delivery address, including but not limited to, house number, building number/name, street address, access codes, names and/or numbers for the intercom, etc. If USPS is unable to deliver the products at the address indicated by the customer, products will be returned to Melanin Hemp Goddess, and we will refund customer within thirty (30) days of the receipt of said products. Returns/Exchanges  

 

Melanin Hemp Goddess strongly believes in our products and wants you to be fully satisfied with your purchase. We are also fully committed to protecting the health and wellness of all of our customers. Due to the nature of our products and our inability to resell or restock such items, we are unable to accept returns or exchanges of products and do not issue refunds. You have 24 hours after placing an order to make a change or cancel by emailing melaninhempgoddess@gmail.com and referencing your order number.  After 24 hours, your order will begin processing and you can NO longer change/cancel your order. 

 

Visible Defects

While we take the greatest care with our products, if a visible defect is apparent at the time of delivery, the customer shall notify melaninhempgoddess@gmail.com within 2 days from the date of delivery. This notice should contain the order number, photo of the defect, and description of the defect to begin the return or exchange process. If a defect is confirmed by Melanin Hemp Goddess shall refund or exchange the product, depending on the nature of the defect. The customer is not required to send back the defective item in order to receive the refund or exchange.  

 

Liability

 

The liability of Melanin Hemp Goddess, including its directors, officers, agents, employees, members, and assignees, shall be limited to money damages in an amount equal to the sale price of each product of which the damages are alleged to have occurred. This liability shall be the extent of our liability, regardless of the form in which any legal or equitable action may be brought, and the foregoing shall constitute customer’s exclusive remedy. In no event will Melanin Hemp Goddess, its directors, officers, agents, employees, members, and assignees, be held liable or be responsible for any for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to loss of use, loss of profits, business interruption, or liabilities to third parties arising from any source, whether Melanin Hemp Goddess knew or should have known of the likelihood of any loss or damages, arising from your use of our Sites or products. Melanin Hemp Goddess disclaims all warranties express or implied with respect to the services rendered under this agreement, including without limitation the warranty of merchantability and warranty of fitness for a particular purpose.

 

Indemnification

You agree to defend, indemnify, and hold us and our officers, directors, employees, successors, licensees and assigns, harmless from and against any claims, actions, or demands, including, without limitation, reasonable legal fees, arising or resulting from: (i) your breach of this Agreement; (ii) your misuse of the content, our Sites, or our products; and (iii) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right.

 

Non-Waiver

Our failure to insist upon or enforce strict performance of any provision of these Terms & Conditions shall not be construed as a waiver of any provision or right. No waiver of any term, provision or condition of this Terms & Conditions, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or shall constitute, a waiver of any other term, provision or condition hereof, whether or not similar, nor shall such waiver constitute a continuing waiver of any such term, provision or condition hereof. No waiver shall be binding unless executed in writing by the party making the waiver. 

 

Choice of Law

 

The Terms & Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina. You agree that any legal action or proceeding between you and Melanin Hemp Goddess for any purpose concerning the Terms & Conditions or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Mecklenburg County, North Carolina, United States. Any cause of action or claim you may have with respect to Melanin Hemp Goddess must be commenced within one (1) year after the claim or cause of action arises.

 

Complete Agreement

 

This Customer Agreement constitutes the complete and exclusive statement of the agreement between you and Melanin Hemp Goddess with respect to the services and supersedes any and all prior or contemporaneous communications, representations, statements and understandings, whether oral or written, between you and Melanin Hemp Goddess concerning the services.
